1. Agreement to Terms

By accessing or using our AI voice calling platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Our Service provides an AI-powered voice calling platform that enables automated outbound and inbound phone calls using conversational AI agents. The Service includes features such as call scheduling, call analytics, transcript generation, and CRM integration.

3. Account Registration

3.1. You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration.

3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3. You must be at least 18 years old to use the Service.

3.4. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Billing

4.1. We offer subscription plans with included call minutes and per-minute overage charges. Plan details, pricing, and included minutes are specified on our pricing page.

4.2. Subscription fees are billed in advance on a monthly or annual basis, as selected by you.

4.3. Overage charges for minutes exceeding your plan's included amount are billed at the end of each billing cycle.

4.4. All fees are non-refundable except as required by law or as specified in our Refund Policy.

4.5. We reserve the right to change our pricing with 30 days' notice. Price changes will apply to your next billing cycle.

4.6. If payment fails, we may suspend or terminate your account until payment is received.

5. Acceptable Use

5.1. You agree to use the Service only for lawful purposes and in accordance with these Terms.

5.2. You agree NOT to:

  • Use the Service for illegal activities, fraud, or harassment
  • Make unsolicited calls in violation of applicable telemarketing laws (including TCPA, CAN-SPAM, GDPR)
  • Impersonate others or misrepresent your identity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any portion of the Service
  • Use the Service to transmit viruses, malware, or harmful code
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to violate any third-party rights

5.3. You are solely responsible for compliance with all applicable laws and regulations regarding phone calls, including but not limited to:

  • Telephone Consumer Protection Act (TCPA)
  • Do Not Call (DNC) regulations
  • General Data Protection Regulation (GDPR)
  • Local telemarketing and privacy laws

5.4. You agree to obtain all necessary consents and permissions before making calls through the Service.

6. Call Content and Data

6.1. You retain ownership of all content, data, and information you provide or generate through the Service.

6.2. You grant us a license to use, store, and process your data solely to provide and improve the Service.

6.3. We may use anonymized, aggregated data for analytics and service improvement purposes.

6.4. You are responsible for the accuracy and legality of all content used in your AI agents and calls.

7. AI Agent Behavior

7.1. Our Service uses third-party AI technology to power conversational agents.

7.2. While we strive for accuracy, AI-generated responses may contain errors or inaccuracies. You are responsible for reviewing and monitoring your agents' performance.

7.3. We do not guarantee specific outcomes from calls made through the Service.

8. Service Availability

8.1. We strive to maintain high availability but do not guarantee uninterrupted or error-free service.

8.2. We may perform scheduled maintenance with reasonable notice.

8.3. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

9. Intellectual Property

9.1. The Service, including all software, designs, text, graphics, and other content, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

9.2. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

10. Third-Party Services

10.1. The Service integrates with third-party services including telephony providers, AI service providers, and payment processors.

10.2. Your use of third-party services is subject to their respective terms and conditions.

10.3. We are not responsible for the availability, accuracy, or performance of third-party services.

11. Limitation of Liability

11.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

11.2. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11.3. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of any third-party rights

13. Termination

13.1. You may cancel your subscription at any time through your account settings.

13.2. We may suspend or terminate your account immediately if you violate these Terms or engage in fraudulent or illegal activity.

13.3. Upon termination, your right to use the Service will cease immediately.

13.4. We are not obligated to retain your data after termination. You are responsible for exporting your data before cancellation.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions.
